Natural variations in gemstones, where applicable

Such minor visual differences shall not automatically constitute a product defect.

Where a product is handmade or contains natural materials, reasonable variations may occur.

5. 925 SILVER REPRESENTATION

Where SamSeth represents a product as 925 Silver, the product shall be represented according to its applicable product specification and applicable standards.

“925 Silver” generally refers to silver with a fineness of 925 parts per thousand.

BIS identifies 925 as one of the permitted silver fineness grades under the applicable silver standard.

SamSeth shall not knowingly misrepresent the purity, composition or material of a product.

6. HALLMARKING

Where a product is sold as hallmarked silver, the applicable BIS hallmarking requirements shall be followed.

BIS states that hallmarked silver articles are subject to the applicable Indian Standard and hallmarking framework. BIS also provides for registration of jewellers selling hallmarked precious-metal articles, subject to the applicable requirements.

Where applicable, product and invoice information relating to hallmarking shall be maintained in accordance with the applicable BIS requirements.

Customers should retain the authentic invoice for hallmarked jewellery.

BIS states that invoices for hallmarked precious-metal articles should contain relevant article details, net precious-metal weight, purity/fineness and applicable hallmarking charges.

7. HALLMARK / HUID INFORMATION

Where HUID-based hallmarking applies to the particular article, the applicable BIS requirements concerning hallmark components and traceability shall be followed.

Customers should not remove, alter or intentionally damage any hallmark, identification marking or product identification.

BIS's current information states that the revised silver standard introduced HUID-based hallmarking for silver jewellery/articles on a voluntary basis from 1 September 2025.

The exact marking requirements applicable to a product should therefore be verified against the current BIS requirements at the time of sale.

8. PRODUCT PURITY & AUTHENTICITY

SamSeth shall maintain reasonable records supporting the product specifications represented to customers.

Where authenticity certificates, purity certificates or other documentation are provided, such documents relate to the product information stated therein.

A certificate should not be interpreted as providing any additional guarantee beyond the terms expressly stated on the certificate.

9. PRODUCT WEIGHT

Jewellery weight may vary slightly depending upon manufacturing, finishing and applicable product specifications.

Where weight is stated as approximate, the customer should understand that the actual product weight may vary within the applicable manufacturing tolerance.

Where the applicable product is sold based on a specified precious-metal weight, the relevant invoice/product documentation shall govern.

10. GEMSTONES & NATURAL MATERIALS

Where jewellery contains gemstones or other natural materials, natural variations may occur.

Such variations may include:

Colour

75. IMPORTANT LEGAL NOTE

These General Rules & Regulations are designed as a comprehensive business drafting framework for an Indian 925 silver jewellery e-commerce platform.

Before publishing them as SamSeth's final legally binding website terms, they should be reviewed and customised by an Indian lawyer/compliance professional for SamSeth's exact business structure, including:

Proprietorship / partnership / LLP / company structure

GST registration

BIS registration/hallmarking status

State-specific requirements

Website/app architecture

Payment gateway

Courier arrangements

Return/refund model

Privacy/data-processing practices

Exact promotional scheme

Applicable Legal Metrology requirements

This is particularly important because BIS hallmarking requirements and e-commerce/data-protection rules can change. BIS maintains the current hallmarking orders and registration framework, while the Department of Consumer Affairs and MeitY publish updates to the relevant e-commerce, consumer-protection and data-protection frameworks.
